Thank you for choosing Shine Again Photography! These Terms & Conditions are designed to make the booking process, session experience, and delivery of your images as clear and straightforward as possible.
By booking a photography session with Shine Again Photography, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
These terms apply to all photography services offered by Shine Again Photography, including portrait sessions, family sessions, couples and engagement sessions, maternity and newborn sessions, senior and graduation sessions, professional headshots and branding sessions, automotive photography, events, mini sessions, and applicable add-ons.
1. Booking & Reservation
A session is not considered officially booked until:
The requested date and time have been confirmed by Shine Again Photography.
Any required retainer or deposit has been paid.
The client has accepted or agreed to the applicable terms and conditions.
Dates and times are reserved on a first-come, first-served basis. A date or time is not guaranteed until the booking requirements have been completed.
Shine Again Photography reserves the right to decline or reschedule a booking when necessary due to scheduling conflicts, safety concerns, illness, emergencies, or other circumstances outside of our reasonable control.
2. Pricing & Payment
All photography services are priced according to the current pricing published by Shine Again Photography at the time of booking.
Prices may vary based on the selected package, session type, location, additional services, and add-ons.
Any additional services or products requested after booking may result in additional charges. Clients will be informed of applicable additional charges before those services are provided whenever reasonably possible.
Unless otherwise stated at the time of booking, the remaining balance must be paid according to the payment schedule provided by Shine Again Photography.
Failure to make required payments may result in the session being cancelled or the delivery of images being delayed until the account is brought current.
3. Retainers, Cancellations & Refunds
Any retainer or deposit paid to reserve a session date may be non-refundable, as it compensates Shine Again Photography for reserving that date and turning away other potential bookings.
If you need to cancel your session, please provide notice as soon as possible.
Cancellation and refund eligibility will depend on the timing of the cancellation and the specific payment terms provided at booking.
If a client cancels with sufficient notice, Shine Again Photography may, at its discretion, offer the option to transfer applicable payments toward a future session.
No refund will be issued for a client who fails to attend a scheduled session without providing appropriate notice.
Shine Again Photography reserves the right to retain payments associated with services already provided, time reserved, expenses incurred, or other non-refundable charges.
4. Rescheduling
We understand that plans can change. When possible, Shine Again Photography will work with clients to find a new date that works for both parties.
Rescheduling requests should be made as early as possible.
A rescheduling request is not guaranteed until a new date and time have been confirmed.
Repeated rescheduling may be subject to additional fees or may require a new booking, depending on the circumstances.
5. Weather & Outdoor Sessions
For outdoor sessions, weather conditions may affect the safety, comfort, or quality of the session.
Shine Again Photography may recommend rescheduling due to:
Severe storms
Lightning
Heavy rain
Unsafe wind conditions
Extreme temperatures
Other hazardous weather conditions
The decision to reschedule due to weather will be made by Shine Again Photography with consideration given to the safety of everyone involved and the ability to produce the expected quality of work.
If an outdoor session needs to be rescheduled because of weather, Shine Again Photography will work with the client to select an available alternative date.
Normal weather conditions, including cloud cover, mild temperatures, or light changes in sunlight, do not necessarily require rescheduling.
6. Client Arrival & Session Time
Clients are expected to arrive on time and prepared for their scheduled session.
The scheduled session time begins at the agreed-upon start time, not when the client arrives.
Late arrival may reduce the amount of shooting time available. The session will generally still end at the originally scheduled time unless Shine Again Photography determines that additional time is available.
If a client is significantly late, Shine Again Photography may need to shorten or reschedule the session.
Additional shooting time may be purchased when available and may be subject to the applicable additional-hour fee.
7. Session Locations
Clients are responsible for providing accurate location information when applicable.
Some packages include one location, while other packages may include multiple locations as specified in the selected package.
Additional locations may be subject to an additional fee.
Travel outside of the included service area may also be subject to additional travel fees.
Shine Again Photography reserves the right to decline a location if it presents an unreasonable safety concern, access restriction, legal restriction, or other condition that prevents the session from being reasonably completed.
8. Client Preparation & Cooperation
Clients are responsible for arriving prepared for their session, including appropriate clothing, personal items, props, vehicles, pets, or other items they wish to include.
Shine Again Photography will provide reasonable posing guidance and direction throughout the session when appropriate.
Clients are encouraged to communicate preferences, concerns, accessibility needs, and important details before or during the session.
For newborn sessions, children, pets, and larger groups, clients understand that sessions may take additional time due to breaks, feeding, changing, calming, or other unexpected circumstances.
9. Children, Pets & Additional Participants
Clients are responsible for the supervision and behavior of children and pets during sessions.
Shine Again Photography will make reasonable efforts to accommodate children and pets, but cannot guarantee specific poses, expressions, behaviors, or outcomes.
For sessions involving multiple people, the client is responsible for ensuring that all participants are aware of the scheduled session and any applicable expectations.
10. Automotive Sessions
For automotive photography, the client is responsible for ensuring that the vehicle is legally accessible to the photographer and suitable for the selected location.
The client is responsible for obtaining permission when photographing on private property or at a location where permission is required.
Shine Again Photography is not responsible for damage to a vehicle resulting from pre-existing conditions, normal environmental conditions, or circumstances outside the photographer's reasonable control.
Clients should communicate any specific vehicle details, modifications, features, or areas they want emphasized during the session.
11. Events & Parties
For event and party photography, the client is responsible for providing accurate event details, including the event date, time, location, expected duration, and any important schedule information.
The client should communicate any important moments, people, activities, or special requests they want prioritized.
Shine Again Photography will make reasonable efforts to photograph important moments but cannot guarantee that every individual, moment, or detail will be captured.
The photographer's ability to photograph an event may be affected by lighting, crowd size, venue restrictions, schedule changes, guest cooperation, or other circumstances outside the photographer's control.
12. Image Selection & Editing
Photography packages include the number of edited images specified in the package selected at booking.
Shine Again Photography will select and professionally edit the final images delivered to the client.
The photographer's selection of final images is part of the creative process. Unedited, duplicate, test, rejected, blurry, or otherwise unusable images are not included in the final delivery.
RAW files and unedited images are not provided unless specifically agreed to in writing.
Editing includes the photographer's normal style and workflow, which may include adjustments to exposure, color, contrast, cropping, skin tones, and other artistic elements.
Extensive retouching or alterations outside of the normal editing process may be available for an additional fee.
13. Artistic Style & Creative Judgment
By booking Shine Again Photography, clients acknowledge that they have reviewed the photographer's portfolio and understand the general photographic and editing style represented by the work.
Photography is an artistic service, and final images may vary based on lighting, location, weather, subjects, clothing, posing, expressions, and other circumstances.
Shine Again Photography will use professional judgment throughout the session and editing process.
Specific poses, images, editing results, or creative effects cannot be guaranteed unless specifically agreed upon in advance.
14. Image Delivery
Final edited images will be delivered using the delivery method specified for the selected package or service.
Where a flash drive is included, the client is responsible for safely storing and backing up their delivered images after receiving them.
Shine Again Photography is not responsible for lost, damaged, corrupted, or deleted files after delivery.
Clients are strongly encouraged to create multiple backups of their photographs.
If images need to be re-delivered after the original delivery period, Shine Again Photography may charge a reasonable retrieval or re-delivery fee if the files are still available.
15. Image Delivery Timeline
Shine Again Photography will provide an estimated delivery timeframe at the time of booking or following the session.
Delivery times may vary depending on the type of session, number of images, workload, holidays, unforeseen circumstances, or other factors.
Rush delivery may be available for an additional fee when offered and when scheduling permits.
Rush delivery does not guarantee delivery at a specific hour unless specifically agreed upon in writing.
16. Copyright & Ownership
All photographs created by Shine Again Photography remain the intellectual property and copyright of Shine Again Photography unless otherwise agreed to in a separate written agreement.
Purchasing a photography session or receiving digital or physical copies of photographs does not transfer copyright ownership to the client.
U.S. copyright law generally provides that the photographer is the initial copyright owner of photographs they create, unless an applicable exception or written transfer applies.
Shine Again Photography retains the right to reproduce, display, publish, and otherwise use photographs as permitted by law and any applicable client usage agreement or model release.
17. Personal Use of Images
Clients receive permission to use their delivered photographs for personal, non-commercial purposes, including:
Personal social media accounts
Personal printing
Sharing with family and friends
Personal announcements
Personal albums and keepsakes
Clients may not sell, license, alter, commercially distribute, or otherwise use the photographs for commercial purposes without written permission from Shine Again Photography.
Clients may not apply filters, heavy edits, AI alterations, or other modifications that materially change the photographer's work without permission.
If a business or organization requires commercial usage rights, those rights must be discussed and approved separately.
18. Photographer's Portfolio & Marketing Use
Shine Again Photography may use photographs created during a session for portfolio, website, social media, advertising, promotional materials, samples, competitions, or other business-related purposes only when the applicable client/model release or booking agreement provides permission to do so.
Clients who do not wish for their images to be used for promotional purposes should communicate that preference before the session and complete any applicable privacy or model-release section provided by Shine Again Photography.
For minors, parental or legal guardian permission will be required where applicable.
19. Privacy & Confidentiality
Shine Again Photography respects the privacy of its clients.
Personal information collected during the booking process will be used for purposes reasonably related to providing photography services, communicating with the client, processing payments, scheduling, and managing the business.
Client information will not knowingly be sold to third parties.
Shine Again Photography may use third-party services for booking, payment processing, communication, website hosting, file storage, or other business operations.
20. Personal Property & Responsibility
Clients are responsible for their personal belongings and items brought to a session.
Shine Again Photography is not responsible for lost, stolen, or damaged personal property unless caused by the photographer's proven negligence.
Clients are also responsible for ensuring that personal items, vehicles, pets, and other property brought to a session are safe and suitable for the selected location.
21. Safety
The safety of clients, guests, pets, the photographer, and equipment is a priority.
Shine Again Photography reserves the right to stop or modify a session if conditions become unsafe.
This may include dangerous weather, hazardous locations, aggressive animals, unsafe vehicle positioning, inappropriate behavior, or other circumstances that create a reasonable safety concern.
No client will be entitled to demand that the photographer perform an action that the photographer reasonably believes is unsafe.
22. Photographer Illness, Emergency & Unforeseen Circumstances
Although Shine Again Photography makes every effort to honor scheduled sessions, circumstances may occasionally arise that prevent the photographer from completing a session.
These circumstances may include illness, injury, family emergencies, severe weather, natural disasters, equipment failure, venue restrictions, or other events outside of the photographer's reasonable control.
When reasonably possible, Shine Again Photography will offer to reschedule the session.
If rescheduling is not reasonably possible, the client will be provided with any applicable refund or alternative resolution based on the circumstances and payments made.
23. Client Conduct
Shine Again Photography is committed to providing a respectful and comfortable experience.
Abusive, threatening, discriminatory, harassing, or inappropriate behavior toward the photographer or any assistant may result in the immediate termination of the session.
If a session is terminated because of client conduct, the client may remain responsible for payments associated with time reserved and services already provided.
24. Add-Ons & Additional Services
Add-ons are intended to supplement a photography session and are not standalone photography services unless specifically stated otherwise.
Examples may include:
Additional edited images
Additional shooting time
Additional locations
Rush delivery
Custom announcements or invitations
Best Friend Mini Sessions
Surprise Proposal coverage
Specialty or creative photography services
Add-ons are subject to availability and may require advance notice.
The price and availability of an add-on will be confirmed before the additional service is provided.
25. Custom Designs
Custom announcements, invitations, cards, or other design services are subject to the details agreed upon at booking.
The client is responsible for providing accurate names, dates, wording, photographs, and other information needed for the design.
Shine Again Photography is not responsible for errors resulting from incorrect information supplied by the client.
Reasonable revisions may be included as specified when the design service is booked. Additional revisions or substantial design changes may result in additional charges.
26. Promotional Offers & Special Pricing
Promotions, discounts, mini sessions, and special offers may have specific terms, availability restrictions, expiration dates, or booking requirements.
Promotional offers cannot be combined unless explicitly stated.
Shine Again Photography reserves the right to modify or discontinue promotions at any time before a booking is completed.
Once a promotional booking has been confirmed, the applicable promotional terms will remain in effect for that booking unless otherwise stated.
27. Limitation of Liability
Shine Again Photography will make reasonable efforts to provide professional photography services and deliver the agreed-upon images.
However, circumstances outside the photographer's reasonable control may affect a session or image delivery.
In the unlikely event that photographs are lost, corrupted, damaged, or otherwise unavailable due to equipment failure, technical failure, data loss, or another circumstance outside of the photographer's reasonable control, Shine Again Photography's liability will be limited to the amount actually paid by the client for the affected photography service, to the extent permitted by applicable law.
28. Changes to These Terms
Shine Again Photography may update these Terms & Conditions from time to time.
The terms applicable to a client's booking will generally be those presented and accepted at the time of booking.
Updated terms may apply to future bookings.
29. Agreement to These Terms
By submitting a booking request, completing a booking, paying for a photography service, or otherwise engaging Shine Again Photography for photography services, the client acknowledges that they have had an opportunity to review these Terms & Conditions and agrees to be bound by the applicable terms.
If a separate photography contract, invoice, booking agreement, model release, or written agreement contains terms that specifically conflict with these Terms & Conditions, the more specific written agreement will control for that particular matter.
